It seemed as if things couldn’t get any worse for Police Officer Patrick Pogan, when his arrest of Christopher Long, a cyclist in the Critical Mass rally, for attacking him was covertly videotaped. Only 10 days on the job and he was shown to be a violent attacker and liar. He had a great future ahead of him on the NYPD. Except for that video . Finally prosecuted . Finally convicted , though not of the vicious assault on Long, because cops have to be allowed some latitude in vicious harming people, but convicted of filing a false instrument. And yesterday, Patrick Pogan was sentenced to life. No, not life in prison. Not life on probation, Not life in…

There’s nothing unusual about a defendant being on trial for his first arrest. What is unusual is when that he’s the person who made the arrest, and it was his first as a police officer. The trial of Jason Pogan for his assault on bicyclist Christopher Long during the Critical Mass rally in Manhattan has opened, which I like to...
“But for Video” has been an ongoing theme here, reflecting the new reality that complaints of police misconduct and abuse, dismissed out of hand despite a defendant appearing at arraignment with eyes blackened, nose broken, teeth missing and a charge of attacking an officer’s fist with his face, can no longer be ignored. The Supreme Court refused on Monday to hear any new cases, bypassing a number of significant issues — including a test of defense lawyers’ right to challenge a juror who admitted to a bias against the Muslim religion, when a believer of that faith was on trial. The Court left intact a sentence of 28 years to life in prison for a college...

When a person’s motives are widely misunderstood, it’s understandable that some people will find his actions inappropriate. Take, for example, Congressman Bob Etheridge (D-NC), captured on video: Naturally, conservative shills amongst us have claimed that he’s engaged in a vicious assault. This is a complete and total misunderstanding,...
The Ronnie Lee Gardner saga appears to have reached its final days. But an interesting thing has happened in the Gardner case in recent days: jurors who sentenced Gardner to death back in ‘85 have come forward to say 1) that they wouldn’t have done so had they heard evidence of Gardner’s troubled childhood and 2) they would have sentenced...
No one with a reasonably adequate education is unfamiliar with double secret probation, imposed by Dean Wormer on the naughty boys of Delta house . It was a knee-slapper at the time, but its real life counterpart may not be nearly as funny. Via Doug Berman , the Washington Post reports: In April, the 53-year-old Beckwith left prison in Massachusetts...
